1. Service Description
CannaComply (“the Service”) is an automated compliance scanning tool that analyzes dispensary websites against New York State Office of Cannabis Management (OCM) advertising and marketing regulations. The Service generates reports identifying potential compliance gaps based on automated analysis.
The Service is not legal advice. CannaComply does not provide legal counsel, regulatory interpretation, or professional compliance consulting. Reports are for informational purposes only. You should consult a qualified cannabis regulatory attorney before making business decisions based on any report.
2. Payment Terms
Free Scan: The initial compliance scan is free and provides a summary of violations found, risk rating, and estimated fine exposure. No payment or account is required.
Full Report: The detailed compliance report costs $997 as a one-time payment. This includes the full report with evidence citations, remediation roadmap, executive summary, downloadable PDF, and 3 total scans (initial scan plus 2 rescans).
Monitoring Subscriptions: Ongoing monitoring is available at $149 per month or $1,497 per year. Subscriptions include weekly automated rescans, compliance alerts, monthly PDF reports, and 3 on-demand rescans per month.
Refund Policy: If you are not satisfied with a Full Report or Monitoring subscription, you may request a full refund within 48 hours of purchase, no questions asked. Refund requests should be sent to support@cannacomply.io.
All payments are processed securely through Stripe. CannaComply does not store credit card numbers or payment credentials.
3. Acceptable Use
By using the Service, you agree that:
- You are a New York State licensed cannabis dispensary, an authorized representative of one, or are evaluating the Service for a licensed dispensary.
- Each scan covers one website. You may not submit URLs for websites you do not own or operate without authorization.
- Reports are for the purchaser’s internal use only. You may not resell, redistribute, or commercially repurpose reports generated by CannaComply.
- You will not use the Service to harass, defame, or harm competitors by sharing their compliance data publicly.
4. Limitation of Liability
CannaComply is not responsible for any regulatory outcomes, fines, penalties, enforcement actions, license suspensions, or other consequences arising from the use or non-use of the Service.
The Service is provided “as is” without warranty of any kind, express or implied. CannaComply makes no guarantees regarding the completeness, accuracy, or fitness for a particular purpose of any scan or report.
In no event shall CannaComply’s total liability exceed the amount paid by you for the specific report or subscription giving rise to the claim.
5. Accuracy Disclaimer
The Service uses automated website crawling, pattern matching, and AI-powered contextual analysis to detect potential compliance issues. While we take accuracy seriously, automated analysis has inherent limitations:
- False positives may occur when automated tools flag content that is actually compliant in context.
- False negatives may occur when violations are not detectable through website scanning alone (e.g., offline advertising, packaging issues, operational compliance).
- The Service cannot scan content behind login walls, embedded third-party iFrames, or dynamically loaded content that requires user interaction beyond standard page navigation.
Reports reflect the state of your website at the time of scanning and the regulatory rules in effect at that time.
6. Intellectual Property
Compliance reports generated by CannaComply are licensed to the purchaser for their internal business use. You may share a report with your attorney, web developer, or compliance consultant for the purpose of remediating identified issues.
You may not publicly post, resell, or redistribute reports. The scanning technology, analysis methodology, rules database, and website content remain the intellectual property of CannaComply.
7. Subscriptions, Auto-Renewal & Cancellation
Monitoring subscriptions automatically renew at the end of each billing period (monthly or annual) unless cancelled before the renewal date.
You may cancel your subscription at any time. Cancellation takes effect at the end of the current billing period — you will continue to receive monitoring services until then. No partial refunds are issued for unused portions of a billing period beyond the 48-hour refund window.

8. Data Retention
Scan data, report results, and associated information are retained in accordance with our Privacy Policy.
9. Governing Law
These Terms of Service are governed by and construed in accordance with the laws of the State of New York, without regard to conflict of law provisions. Any disputes arising from or related to the Service shall be resolved in the courts of the State of New York.
10. Changes to These Terms
We may update these Terms of Service from time to time. Material changes will be communicated via the email address associated with your account. Continued use of the Service after changes take effect constitutes acceptance of the updated terms.
