9 NYCRR §129.2(k)

Where does a NY dispensary have to show its license number?

In all advertising. Under 9 NYCRR §129.2(k), a licensee must accurately and legibly include its name and license number in all advertising and advertisements, unless the Office has approved the form of the ad otherwise.

What the regulation says

(k) A licensee shall accurately and legibly include its name and license number in all advertising and advertisements, unless the form of the advertising or advertisement has been otherwise approved by the office. This requirement does not apply to brand representatives or cannabis merchandise; however, if using a brand representative, licensees must provide a license number upon request.

9 NYCRR §129.2(k), quoted word for word from OCM’s published text (9 NYCRR Parts 128 & 129, as adopted December 3, 2025, page 21). Checked against the source on October 2, 2026.

What the rule requires

  • Both the name and the license number, accurately and legibly.
  • On a website, a site-wide footer is the simplest way to have it on every page.
  • Social media is covered separately: §129.2(m) requires the license or permit number on the profile page of the account, along with text stating that cannabis products are legal only for persons twenty-one or older.
  • Brand representatives and cannabis merchandise are exempt, but a licensee using a brand representative must give the license number on request.

Penalty

OCM can fine up to $5,000 per advertising violation (Cannabis Law §16). The actual amount is set case by case. Estimate your exposure.
