What the regulation says

(d) Any advertising or advertisement, except for audio-only advertising or advertisements, brand representatives, and cannabis merchandise, or except as otherwise approved by the office, shall include one of the following warnings in a rotating manner as directed by the office, in their entirety in a conspicuous manner on the face of the advertising or advertisement or clearly read aloud at the same volume and pace and in the same language as the rest of the advertising or advertisement: (1) "Cannabis can be addictive."; (2) "Cannabis can impair concentration and coordination. Do not operate a vehicle or machinery under the influence of cannabis."; (3) "There may be health risks associated with consumption of this product."; (4) "Cannabis is not recommended for use by persons who are pregnant or nursing."; or (5) Other warnings as authorized by the office.

What the rule requires

  • One of the four warnings above (or another warning the Office authorizes) appears on the advertising, word for word.
  • They are shown "in a rotating manner as directed by the office". The text of §129.2(d) does not set a rotation schedule itself.
  • This is in addition to the mandatory warning statement, not instead of it.

Penalty

OCM can fine up to $5,000 per advertising violation (Cannabis Law §16). The actual amount is set case by case. Estimate your exposure.
